Justice Jackson takes issue with Thomas in citizenship reasoning
“Despite his longstanding endorsement of a a ‘colorblind’ Constitution, Justice Thomas now surprisingly suggests that the Citizenship Clause was a race-conscious remedial measure, relating only to ‘freed slaves such as Dred Scott,’” she wrote, calling that a “narrow vision” of Reconstruction’s intended expansion of democracy.
“This alternative account pitches Black Americans against immigrants when the advocates who promoted the Fourteenth Amendment did no such thing,” Jackson wrote. “Freed Blacks fought for the shared humanity of all people.”
This is how the supreme Court should be. The Citizenship Clause can affect anyone. My readers, I agree with Ketanji that the interpretation and application of the law here is very much narrow. It is a reminder of how the laws are sometimes narrowly applied for the persecutions of blacks versus White and other races…such can we not say that interpretation of the law is race-conscious… The measure in such suspicious circumstances of bias then being the very interpretation of the law for the application of judgement…Ketanji is proof there is no doubt in my mind that there is no sound measure greater than the freeing of a mind, especially that of a black woman. Nobody is more faithful to the liberal cause for instance…I am just supporting the Democrats because I want simple shared dignity Ketanji discusses back… let’s make America human again…it is rather sickeningly unfeeling at the moment…
